Event: Singles Party Cruise (Long Beach)

I, the undersigned, hereby acknowledge and agree to the following terms and conditions as a participant in

the Singles Party Cruise ("the Event") hosted by Off The Couch Adventures, LLC ("the Company"):

1. Assumption of Risk: I understand that participation in the Singles Party Cruise Event involves

inherent risks, including but not limited to, slip and falls, harm, injury, or death that may occur

while on the boat, or as a result of interactions with other attendees. These risks include, but are

not limited to, the following:

• Marine-Related Incidents: These include but are not limited to capsizing or sinking of the boat, collisions with other vessels or objects, and adverse weather conditions that may affect the safety and stability of the boat.

• Drowning: There is a risk of drowning due to falling overboard, inability to swim, or any other water-related accidents.

• Falling Overboard: Participants may accidentally fall overboard, leading to potential injury or drowning.

• Slip and Falls: Wet surfaces, sudden movements of the boat, or obstacles on the deck may cause participants to slip and fall, leading to possible injuries.

• Interaction with Other Attendees: There may be risks associated with interactions with other attendees, including but not limited to physical altercations, unwanted physical contact, or other harmful interactions.

• Medical Emergencies: Participation in the Event may lead to unforeseen medical emergencies, including but not limited to heart attacks, seizures, or allergic reactions. 

• Alcohol Consumption: The consumption of alcohol can impair judgment and physical coordination, increasing the risk of accidents and injuries.

• Equipment and Facilities: The use of equipment and facilities on the boat may pose risks if not used properly, including but not limited to injuries from recreational activities or equipment malfunction.

I voluntarily assume all such risks, whether known or unknown, and understand that the

Company cannot foresee all potential risks and hazards associated with the Event.

2. Release and Waiver: 

I hereby release, waive, and discharge the Company (Off The Couch

Adventures, LLC; Los Angeles Fun Events (DBA), its officers, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in the Event or while on the premises where the Event is conducted.

3. Indemnification: I agree to indemnify and hold harmless the Company from any loss, liability, damage, or costs, including court costs and attorneys' fees, that may arise due to my participation in the Event.

4. Medical Treatment: I consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Event. I understand and agree that I am solely responsible for all costs related to such medical treatment, and I release the Company from any liability for any injury or damage that may occur as a result of such treatment.

5. Security and Boarding: I understand that security personnel have the authority to make decisions

regarding my participation, including denial of boarding for any reason they deem necessary. I agree to comply with all security procedures and instructions.

6. Code of Conduct: I agree to conduct myself in a respectful and safe manner during the Event. I understand that any behavior deemed inappropriate by the Company or its representatives may result in my removal from the Event without any refund or compensation.

7. Severability: If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

8. Governing Law: This waiver and release shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.

Media Release

I grant Off The Couch Adventures, LLC permission to use my image, voice, and participation in the

Singles Party Cruise for promotional purposes in any media, without compensation. I release the Company

from any claims related to this use.

I HAVE READ AND AGREE TO THIS MEDIA RELEASE.

I HAVE READ THIS WAIVER AND RELEASE, FULLY UNDERSTAND ITS TERMS, AND SIGN IT

FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
